This data protection declaration is intended to inform the users of this website about the type, scope and purpose of the collection and use of personal data by Bialas Immobilien. We take data protection very seriously and treat your personal data confidentially and in accordance with legal regulations. As new technologies and the constant further development of this website may result in changes to this data protection declaration, we recommend that you read the data protection declaration again at regular intervals. Data Protection

We take the protection of your personal data very seriously and treat your personal data confidentially, in accordance with the EU General Data Protection Regulation and the Federal Data Protection Act. When you contact us, whether by e-mail or via a contact form, the data you provide will be stored by us to be able to answer your questions or concerns. The storage takes place especially if you have a request that we can only process and settle by storing your data. Personal data is data that can be used to identify you directly or indirectly. This data protection declaration explains what data we collect, what we use it for and when we will delete it.

1. Access Data

When you visit our website www.bialasimmobilien.de or www.bialasrealestate.com, the browser used on your device automatically sends information to the server on our website (see Art. 6 Para. 1 lit. f. GDPR). This information is temporarily stored in a so-called “server log file”. 

The following information is recorded, logged and stored until it is automatically deleted:

  • IP address used
  • Date and time of access
  • Amount of data sent in bytes
  • Name and URL of the retrieved file
  • Website from which access is made (referrer URL)
  • Browser used
  • The operating system used on your device and the name of your access provider

The data mentioned is processed by us for the following purposes:

  • Ensuring a smooth connection establishment of the website
  • Ensuring a comfortable use of our website
  • Evaluation of system security and stability
  • Administrative purposes
  • To correspond with you to be able to answer your request

The server log files are stored for a maximum of 7 days and are then deleted. The data is stored for security reasons, e.g., to be able to clarify cases of abuse. If data must be kept for reasons of proof, they are excluded from deletion until the incident has been finally clarified.

The legal basis for data processing is Article 6 Paragraph 1 Clause 1 Letter f GDPR. Our legitimate interest follows from the data collection purposes listed above and is necessary for the appropriate processing of your order or your interest in buying a property and thus for the mutual fulfillment of obligations.

Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person. In addition, we use cookies and analysis services when you visit our website. You will find further explanations in that regard below.

2. Contact Form

If you contact us via the contact form or through the offered contact options such as e-mail, your details will be saved so that they can be used to process and answer your request. This data will not be passed on to third parties without your consent.

The processing of the data provided in the contact form is therefore exclusively based on your consent (Article 6 (1) (a) GDPR). You can revoke this consent at any time. An informal message by e-mail to us is sufficient. The legality of the data processing operations that took place up until the revocation remains unaffected by the revocation.

The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

3. Sharing of Data

Your personal data will not be transmitted to third parties for purposes other than those listed below.

We only pass on your personal data to third parties if

  • You have given your express consent to this in accordance with Art. 6 Para. 1 S.1 lit a GDPR or
  • the transfer according to Art. 6 Para. 1 S. 1 lit f DSGVO for order processing, in particular for our verification or mediation is required and there is no reason to believe that you have an overriding legitimate interest in not disclosing your data; 
  • If disclosure is necessary for the processing of contractual relationships with you in accordance with Article 6 Paragraph 1 Sentence 1 Letter b GDPR.

Personal data is all information that is used to identify your person and which can be traced back to you – for example your name, email address and telephone number.

You can also visit our website without providing any personal information. To improve our online offer, however, we save your access data to this website (without personal reference). This access data includes the information listed above, e.g. the file you requested or the name of your Internet provider.

Due to the anonymization of the data, it is not possible to draw conclusions about your person.

4. Cookies

IP-Anonymization

We have activated the IP anonymization function on this website. As a result, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before it is transmitted to the USA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

6. Plugins und Tools

Contact Form

We use Forminator, a Contact Form plugin, to facilitate communication and interaction with our website visitors. Forminator is a plugin tool developed by WPMU DEV / Incsub, LLC, PO Box 548 #88100, Birmingham, AL 35201, USA. Forminator is a Contact Form plugin that allows users to create custom contact forms for their websites. As a Contact Form plugin, Forminator collects personal data that is necessary to facilitate communication between the website owner and their visitors.

Under the General Data Protection Regulation (GDPR), personal data is defined as any information that can directly or indirectly identify an individual. The personal data collected by Forminator includes:

  • Name: The name of the person submitting the form
  • E-mail Address: The email address of the person submitting the form
  • Subject: The subject of the message submitted through the form
  • Message: The actual message submitted through the form
  • IP address: The IP address of the visitor submitting the form

In addition to this, Forminator may also collect technical information such as browser type and version,  operating system, and other similar technical data.

It is important to note that Forminator does not collect any sensitive personal data, such as financial information or social security numbers

Google Web Fonts

This site uses so-called web fonts provided by Google for the uniform display of fonts. When you call up a page, your browser loads the required web fonts into your browser cache in order to display text and fonts correctly.

For this purpose, the browser you are using must connect to the Google servers. This gives Google knowledge that our website was accessed via your IP address. Google Web Fonts are used in the interest of a uniform and appealing presentation of our online offering. This represents a legitimate interest within the meaning of Article 6 (1) (f) GDPR.

Google Maps

This site uses the Google Maps map service via an API. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

In order to use the functions of Google Maps, it is necessary to save your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. Google Maps is used in the interest of an attractive presentation of our online offers and to make it easier to find the places we have indicated on the website. This represents a legitimate interest within the meaning of Article 6 (1) (f) GDPR.

Google Conversion-Tracking

This website uses the online advertising program “Google AdWords” and, as part of this, conversion tracking to measure which websites advertisements work the best. The conversion tracking cookie is set when a user clicks on an ad served by Google or its partners. The cookies set as a result lose their validity after 30 days and are not used for personal identification. Using this cookie, we and Google can identify which ad brought you to our website. Each visitor who came to our site via Google AdWords receives a different cookie. The information collected using the conversion cookie is used to determine which visitors have triggered a specific action on our website via ads. We learn the total number of users who clicked on our ads and which clicks led to an action. We do not receive any information with which a user can be personally identified.

Users who do not wish to participate in the tracking can easily delete or generally deactivate the Google conversion tracking cookie via their Internet browser under user settings. These users will then not be included in the conversion tracking statistics.

Google Remarketing

7. User Rights

According to Art. 15 GDPR, you have the right to request information about your personal data processed by us.

In particular, you can request information about

  • the processing purposes
  • the category of personal data
  • the categories of recipients to whom your data has been or will be disclosed
  • the planned storage time
  • the existence of a right to rectification, erasure, restriction of processing or objection
  • the existence of a right of appeal
  • the origin of your data, if they were not collected from us, as well as
  • about the existence of automated decision-making including profiling and, if necessary, meaningful information on its details.

In accordance with Art. 16 GDPR, you can immediately request the correction of incorrect or completion of your personal data stored by us;

in accordance with Art. 17 GDPR, you can request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims is required;

in accordance with Art. 18 GDPR, you can request the restriction of the processing of your personal data if you dispute the accuracy of the data, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you use them to assert or to exercise or defend legal claims or you have objected to processing in accordance with Art. 21 GDPR;

in accordance with Art. 20 GDPR, you can receive your personal data that you have provided to us in a structured, common and machine-readable format or request transmission to another responsible person;

according to Art. 7 Para. 3 GDPR, you can revoke the consent you have given us at any time. As a result, we are no longer allowed to continue the data processing based on this consent for the future.

According to Art. 77 GDPR you can complain to a supervisory authority. The responsible supervisory authority in Berlin is the state data protection officer of the state of Berlin.

8. Right to Object

If your personal data is processed based on legitimate interests in accordance with Article 6 Paragraph 1 Sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Article 21 GDPR, provided there are reasons for this, which arise from your particular situation, or the objection is directed against direct advertising. In this case, you even have a general right of objection, which we will implement without specifying a particular situation.

9. Data Security

When you visit our website, we use the widespread SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. This is usually a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed representation of the key or lock symbol in the lower status bar of your browser. We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
